By creating an account, browsing listings, or using BenueHomes, you agree to comply with these Terms and Conditions. If you do not agree, please do not use the Platform.

1. About BenueHomes

BenueHomes is a digital real estate marketplace designed to connect property buyers, renters, landlords, agents, and property owners across Benue State.

BenueHomes primarily acts as a facilitator and marketplace platform, helping users discover, advertise, and connect regarding verified property opportunities.

2. Eligibility

To use BenueHomes, you must satisfy the following criteria:

• Be at least 18 years old
• Provide accurate, verifiable, and truthful information
• Have full legal authority to enter into binding agreements
• Comply with all applicable Nigerian laws and platform regulations

We reserve the right to suspend or terminate accounts found to contain false, misleading, fraudulent, or unauthorized information.

3. User Accounts

When creating an account on BenueHomes, you agree to:

• Provide accurate registration details
• Maintain updated contact and profile information
• Keep your login credentials strictly confidential and secure
• Accept full responsibility for all activities conducted under your account

Users are responsible for maintaining account security. BenueHomes will not be liable for unauthorized access caused by user negligence.

4. Property Listings

Users and registered agents may upload properties for sale, rent, or lease. By listing a property, you agree that:

• You own the property or are legally authorized to advertise it
• All information provided is truthful, accurate, and not misleading
• Images and descriptions belong to you or are lawfully permitted for promotional use
• Pricing, availability, and inspection terms are genuine

BenueHomes reserves the right to remove, suspend, reject, or edit listings that are misleading, fraudulent, contain false pricing, include prohibited content, violate laws or platform rules, or harm user trust and safety.

5. Platform Role and Liability Disclaimer

BenueHomes serves only as a technology platform connecting users. BenueHomes does not guarantee:

• Property ownership authenticity without physical inspection
• Property structural, legal, or environmental condition
• Uninterrupted availability of listed properties
• Accuracy of third-party user claims
• Successful completion or satisfaction of transactions
• Payment recovery or escrow in private disputes

Users are solely responsible for conducting physical inspections, verifying title documents, confirming owner identity, seeking legal counsel where necessary, and exercising caution before making any payment.

All property arrangements and payments are conducted at users' own discretion and risk.

6. Payments and Fees

BenueHomes may charge fees for premium listings, featured property promotions, subscription services, advertising packages, and commission-based services where applicable.

All payments made through the Platform may be processed through licensed third-party payment providers. BenueHomes reserves the right to modify fees at any time.

Unless required by applicable consumer law, payments made for services already rendered are non-refundable.

7. Off-Platform Transactions

Users are strongly encouraged to maintain communication and transaction transparency within official platform channels.

BenueHomes shall not be responsible for disputes, scams, fraud, financial losses, or damages arising from private off-platform agreements between buyers, renters, and third-party agents.

Any arrangement entered outside BenueHomes is solely between the involved parties.

8. Prohibited Activities

Users and agents must not:

• Post fake, duplicated, or deceptive property listings
• Impersonate agents, property owners, government representatives, or organizations
• Upload misleading, unauthorized, or stolen property images
• Engage in fraud, advance-fee scams, or dishonest practices
• Harass, threaten, or abuse other users
• Attempt unauthorized access to servers, databases, or platform systems
• Use automated scrapers, data-mining bots, or crawler abuse
• Violate applicable state, federal, or international laws

Violations will result in immediate account suspension, listing revocation, permanent platform ban, and reporting to relevant Nigerian law enforcement agencies where criminal activity is detected.

9. User Verification

BenueHomes may implement identity verification procedures for users, agents, and property owners, including government-issued identity verification and business registration checks.

Verification confirms documentation checks conducted by BenueHomes, but does not guarantee legitimacy or replace personal due diligence. Users must always conduct independent inspection before concluding deals.

10. Intellectual Property

All BenueHomes branding, logos, graphics, platform design, software code, and systems are the exclusive intellectual property of BenueHomes unless otherwise stated.

Users may not copy, reproduce, reverse engineer, modify, or distribute platform materials without prior written consent.

Users retain ownership of property photos and descriptions they upload, but grant BenueHomes a non-exclusive, transferable, royalty-free license to host, display, adapt, and distribute such media for platform promotion and marketplace discovery.

11. Account Suspension and Termination

BenueHomes reserves the right to suspend or permanently terminate user accounts that violate these Terms, engage in suspicious activity, pose safety risks, or breach legal regulations.

We may unpublish listings or restrict access immediately and without prior notice where necessary to protect our community.

12. Limitation of Liability

To the fullest extent permitted by Nigerian law, BenueHomes, its officers, employees, and agents shall not be held liable for:

• Direct or indirect financial losses resulting from peer-to-peer property transactions
• Fraudulent misrepresentations by third parties
• Property title, boundary, or tenant disputes
• Inaccurate property descriptions uploaded by users or agents
• Platform downtime, service interruptions, or technical errors
• Loss of profits, data, goodwill, or business opportunities

Platform use is strictly at the user's sole risk.

13. Indemnification

You agree to defend, indemnify, and hold harmless BenueHomes, its founders, directors, employees, affiliates, and partners against all claims, liabilities, damages, losses, or legal costs arising from:

• Your misuse or unlawful access to the Platform
• Your listings, photos, videos, or uploaded materials
• Your interactions, inspections, or private agreements with other users
• Your violation of any provision of these Terms

14. Service Availability

While we strive for high uptime and smooth performance, BenueHomes does not guarantee continuous, uninterrupted, or bug-free access.

We may perform scheduled maintenance, apply platform updates, or discontinue features without liability.

15. Privacy

Your privacy and data rights are fundamental to us. Our data handling procedures are detailed in our dedicated Privacy Policy, which forms an integral part of these Terms.

16. Changes to These Terms

BenueHomes may update these Terms periodically to reflect product changes, user feedback, or regulatory requirements.

Continued use of the Platform after the posting of modified Terms constitutes full acceptance of the updated rules.

17. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the Federal Republic of Nigeria.

Any disputes that cannot be settled amicably through mutual discussion or mediation shall be submitted to the jurisdiction of competent courts located in Nigeria.
